These Terms of Use (the "Terms") form a binding agreement between you and the operator of The Palisades Guide (the "Site," "we," "us," or "our"). By accessing, browsing, or otherwise using the Site, you accept these Terms and our Privacy Policy and Cookie Notice, which are incorporated here by reference. If you do not agree to these Terms, you must not use the Site.

We may revise these Terms at any time by posting an updated version on this page. Changes take effect when posted. Continued use of the Site after changes constitutes acceptance of the revised Terms.

The Site is an independent informational and editorial resource about The Palisades community in Charlotte, North Carolina. We do not own, operate, manage, govern, or represent The Palisades community, its homeowners association or any sub-association, its country club, its golf course, its marina, its amenity facilities, or its developer.

Nothing on the Site is an official statement, rule, interpretation, covenant, bylaw, notice, or communication of any homeowners association, architectural review committee, club board, property manager, or developer. For official information — including governing documents, covenants, conditions and restrictions (CC&Rs), architectural guidelines, assessments, dues, membership terms, and community rules — you must contact the relevant official organization directly and rely solely on the documents it provides.

All names, trademarks, service marks, logos, and trade dress referenced on the Site are the property of their respective owners and are used only for identification, commentary, and editorial context under nominative fair use.

All content on the Site is provided for general informational and editorial purposes only. It does not constitute and must not be relied upon as legal, financial, tax, investment, insurance, appraisal, engineering, architectural, construction, inspection, or real estate advice.

We are not acting as your real estate broker, agent, transaction facilitator, fiduciary, or advisor, and no such relationship is created by your use of the Site. Nothing on the Site is an offer to sell or a solicitation of an offer to buy any property, security, membership, or service. The only contact mechanism on the Site is a single inquiry form that opens your own email application so you may send a message to a single designated recipient. Do not submit confidential, sensitive, financial, health, or legally privileged information. No confidential, fiduciary, agency, or attorney-client relationship is created by contacting us.

Any feedback, suggestions, corrections, or ideas you send are non-confidential, and you grant us a perpetual, worldwide, royalty-free license to use them without obligation or compensation.

The site and all content are provided "as is" and "as available," with all faults and without warranty of any kind. These Terms are governed by the laws of the State of North Carolina, without regard to its conflict-of-law rules. You and we agree that any dispute arising out of or relating to the Site or these Terms will be brought exclusively in the state or federal courts located in Mecklenburg County, North Carolina, and you consent to personal jurisdiction and venue there.

Any claim you may have arising out of or related to the Site must be filed within one (1) year after the claim arises, or it is permanently barred. Claims must be brought in an individual capacity and not as a plaintiff or class member in any class, collective, or representative proceeding.

We respect intellectual property rights. If you believe content on the Site infringes your copyright, send a notice through our contact form including: identification of the copyrighted work; identification of the material claimed to be infringing and its location on the Site; your contact information; a statement that you have a good-faith belief the use is not authorized; a statement, under penalty of perjury, that the information is accurate and that you are the owner or authorized to act on the owner's behalf; and your physical or electronic signature. We will investigate and remove or disable material where appropriate.

If any provision of these Terms is held unenforceable, that provision will be limited or severed to the minimum extent necessary and the remaining provisions remain in full force. Our failure to enforce any provision is not a waiver. These Terms, together with the Privacy Policy, Cookie Notice, and Disclosures, are the entire agreement between you and us regarding the Site. We may modify, suspend, or discontinue the Site or any part of it at any time without notice or liability.
